Thank you for choosing Funseekers Boat Charters! To ensure a safe, enjoyable, and memorable experience for everyone, we ask that you review and agree to our terms and conditions. This document forms our charter agreement and outlines the expectations for your trip.
1. Booking Process & Payments
- Securing Your Charter More Than 30 Days In Advance: If you are booking your charter more than 30-days in advance, you will have an option to simply pay a non-refundable 50% deposit to secure your booking. No booking is confirmed until this deposit has been received.
- Securing Your Charter Less Than 30 Days In Advance: If you are booking your charter less than 30-days in advance, you will be required to pay in full to secure your booking. No booking is confirmed until payment in full has been received.
- Final Payment: Any outstanding balance must be paid 15-days prior to your charter date.
- Included Costs: Your charter fee includes the vessel, a licensed captain, fuel, all standard safety equipment and a large capacity ice chest.
- Gratuity: A customary gratuity of 15-20% for the captain and crew is greatly appreciated for excellent service, but is not included in the charter fee.
2. Cancellations & Refunds
Our cancellation policy is designed to be fair to our guests while protecting our ability to operate. For a complete overview of timelines for full or partial refunds, rescheduling terms, and non-refundable fees, please refer to our full Cancellation Policy Page.
3. Weather Policy
Safety is our absolute priority. All decisions regarding weather are at the sole discretion of the captain.
- Captain's Authority: The captain continuously monitors marine weather forecasts and has the final authority to delay, reschedule, or cancel a charter due to unsafe conditions such as high winds, heavy rain, or lightning.
- Unsafe Weather Cancellations: If we must cancel your charter due to hazardous weather, you will be given the option to reschedule for a future date (subject to availability) or receive a full refund.
- Non-Hazardous Weather: We do not cancel or issue refunds for cloudy days, scattered showers, or other non-hazardous weather conditions.
4. Arrival & Late Policy
Your charter time begins at the scheduled start time and ends at the scheduled end time.
- Punctuality: We ask that you and your guests arrive 20 to 30 minutes prior to your scheduled departure to allow time for boarding and a safety briefing.
- Late Arrivals: Charter times cannot be extended to accommodate late arrivals. If you are late, your charter will end at the originally scheduled time. There are no refunds or partial refunds for time missed due to late arrivals or for returning to the dock early.
- No-Shows: Failure to arrive for your charter will be considered a "no-show," and the full charter fee will be forfeited.
5. Alcohol & Onboard Conduct
We aim to provide a fun and safe environment for all our guests.
- Alcohol: Guests of legal drinking age (21+) are permitted to bring and responsibly consume alcoholic beverages. We maintain a zero-tolerance policy for underage drinking.
- Conduct: The primary charterer is responsible for the conduct of their entire party. The captain reserves the right to terminate any charter without refund if guests engage in unsafe, unruly, or illegal behavior.
- Prohibited Items: Illegal drugs, firearms, and red wine (due to staining) are strictly prohibited onboard.
6. Damage Liability & Cleaning
- Guest Responsibility: The charterer is financially responsible for any damage to the vessel, its equipment, or its contents that is caused by the negligence of any member of their party.
- Excessive Mess: A cleaning fee may be assessed if the vessel is left in a state of excessive disarray that requires more than standard cleaning.
7. Captain’s Authority
- The captain is in full command of the vessel, and their authority is absolute. All passengers must comply with the captain's instructions, especially concerning safety and vessel operation. Non-compliance may result in the immediate termination of the charter without a refund.
8. Liability Waiver
- All passengers are required to sign a liability waiver before boarding. By participating in a charter, all passengers acknowledge and accept the inherent risks associated with boating and water activities. Funseekers Boat Charters is not liable for personal injury or loss/damage of personal items.
9. Children & Pets
- Children: Children are welcome! We require that all children under the age of 13 wear a U.S. Coast Guard-approved life jacket at all times while the vessel is underway. Parents or guardians are responsible for the supervision of their children.
- Pets: For the safety and comfort of all guests and to maintain the condition of our vessels, pets are not permitted onboard. Please inquire about service animals when booking.
10. Inclement Weather & Mechanical Issues
- In the rare event that your charter is cut short due to unforeseen mechanical failure or a sudden turn in weather deemed unsafe by the captain, we will offer a partial refund or a full credit towards a future charter.
11. Indemnification Clause
- The charterer agrees to indemnify and hold harmless Funseekers Boat Charters, its owners, captains, and employees from and against any and all claims, liabilities, damages; and expenses arising from any personal injury, loss of life, or damage to property caused by the charterer or any member of their party.
12. Governing Law
- This agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action or proceeding arising under this agreement will be brought exclusively in courts located within the applicable jurisdiction of Texas.
By booking a charter with Funseekers Boat Charters, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
